“Certainly. An executor is appointed in a will to manage your estate after you pass away. They handle tasks like paying debts, filing taxes, and distributing assets according to your wishes. A trustee, on the other hand, manages assets held in a trust, which can be beneficial for situations involving minors, protecting assets from creditors, or minimizing estate taxes,” explains Bliss. “Choosing the right person for this role is paramount. They need to be trustworthy, organized, and capable of handling financial matters responsibly.
Consequently, it’s essential to carefully consider potential candidates. Family members are often chosen but may not always be the best fit due to personal circumstances or lack of experience. Friends, professionals like accountants or attorneys can also serve as executors or trustees.”
Bliss adds a reminder that “open communication with your chosen executor or trustee is crucial. Discuss your wishes in detail and provide them with all necessary documentation. This proactive approach can help ensure a smooth transition of assets after you’re gone.”
“I recall a case where a client named their adult son as executor, assuming he was well-suited for the role,” shares Bliss. “Unfortunately, the son was going through personal difficulties and ultimately proved unable to fulfill his duties. This led to complications and delays in settling the estate. Ultimately, we had to petition the court to appoint a professional administrator.”
