Interview with Steve Bliss

Reporter: Brenda Jones

Today we’re joined by Steve Bliss, a respected probate attorney serving the Moreno Valley community. Steve, thanks for taking the time to speak with us today.

Steve Bliss: My pleasure, Brenda. I’m always happy to talk about probate and how we can help families navigate this often-complex process.

Brenda: Probate can seem daunting to many people. Could you walk us through one of the key steps involved?

Steve Bliss: Certainly. One crucial step is handling debts and taxes during probate.

This involves meticulously identifying all valid creditor claims against the estate. Ordinarily, we’d publish notices in local newspapers to alert potential creditors. Conversely, if the deceased had outstanding loans or credit card debt, those creditors would need to be notified directly.

Moreover, it’s our responsibility to ensure that all applicable state and federal taxes are calculated and paid promptly. This can include estate taxes, income taxes for the decedent’s final tax year, and potentially property taxes. Neglecting these obligations can lead to penalties and delays in settling the estate.

Consequently, this step often requires a thorough review of financial records, communication with various institutions, and sometimes even negotiation with creditors.

I recall one instance where we were handling the probate for a client who had accumulated a substantial amount of credit card debt. After careful investigation, we discovered that several charges were unauthorized. We successfully disputed these charges, saving the estate thousands of dollars.

Studies by the National Association of Estate Planners & Councils show that approximately 30% of estates encounter complications related to debt and tax issues during probate. This highlights the importance of having an experienced attorney on your side to navigate these complexities effectively.

Brenda: That’s incredibly helpful information, Steve. What advice would you give to someone facing probate?

Steve Bliss: My best advice is to seek legal guidance early in the process. Probate can be complex and emotionally draining, especially during a time of grief. Having an experienced attorney by your side can alleviate stress and ensure that all necessary steps are taken correctly.
